General Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

1. Distance selling:
a system organized by the seller or service provider for the sale or provision of services at a distance, where, up to and including the conclusion of the contract, only one or more techniques for distance communication are used;

2. Agreement:
any agreement regarding distance selling;

3. Distance communication technique:
a means that can be used to conclude a distance contract without the simultaneous presence of the parties;

4. Coffeerista.com:
or the company, if applicable, the part of the company engaged in distance selling and affiliated with the Dutch Post Order Association. Coffeerista.com does not include those engaged in the distance sale of insurance;

5. Consumer:
the buyer of goods or recipient of services, being a natural person who does not act in the exercise of a profession or business;

6. Offer: any offer of goods and/or services, including the applicable conditions, as made by the company in its catalogues, brochures or otherwise to the consumer;

7. Price:
the price of the offered good or service, excluding additional costs, which are separately stated and agreed upon;

8. Withdrawal period:
the period within which the consumer can exercise his right of withdrawal;

9. Ongoing transaction: a distance contract concerning a series of goods and/or services, the delivery and/or receipt of which is spread over time;

10. Dispute Committee:
the Dispute Committee Thuiswinkel, Surinamestraat 24, 2585 GJ The Hague.

Article 2 – Identity
Coffeerista.com provides its statutory name and actual address in a timely manner before the conclusion of the contract.

Article 3 – General conditions
1. Before the distance contract is concluded, the consumer must be provided with the text of the applicable general terms and conditions. If this is not necessary or reasonably not possible, a reference will be made to the free of charge or previously online available general terms and conditions.

2. The general terms and conditions apply to any contract between Coffeerista.com and the consumer, regardless of the communication method used.

3. Deviating provisions must be recorded in writing. In the absence of written documentation, deviations may be proven by either party by any lawful means.


Article 4 – The offer
1. The offered goods and/or services shall be clearly and truthfully represented and/or described as fully as reasonable, with the commercial intent being clear. Any limited validity of the offer must be clearly stated.

2. Each offer must contain sufficient information for the consumer to understand the rights and obligations associated with accepting the offer, particularly the price, the right of withdrawal, payment method, minimum duration of the distance contract, shipping costs, and other conditions.

3. If Coffeerista.com offers deferred or installment payment options, the conditions for such payment will be disclosed in the offer.

4. If Coffeerista.com offers the consumer the possibility to contact the company via a distance communication technique other than the basic tariff, the costs must be disclosed in the offer.

5. Use of automated calling systems or fax for promotional purposes requires prior consent from the consumer.


Article 5 – Withdrawal period
1. The offer includes a withdrawal period of 30 working days, starting the day after receipt by or on behalf of the consumer, unless otherwise agreed.

2. During the withdrawal period, the consumer has the right to return the received goods without obligation, except for direct return costs, or to indicate non-use of the offered services. For services, the withdrawal period applies as a reflection period.

3. Limitations or exclusions of the withdrawal period due to the nature of the goods or services must be clearly stated in the offer.

4. The consumer can only exercise the withdrawal period in the manner indicated by Coffeerista.com in the offer or upon delivery.

Article 6 – Conclusion of the agreement
1. The contract is concluded upon acceptance of the offer and compliance with the stated conditions.

2. When a withdrawal period applies, exercising it is considered a suspensive condition.

3. Coffeerista.com may, in accordance with legal provisions, offer purchase on trial and grant the withdrawal period suspensive effect.

4. Any advance payments will be refunded within 30 days if the contract is not concluded or is withdrawn.

5. Coffeerista.com takes appropriate technical and organizational measures to secure electronic transmission of personal information, especially payments.

6. Coffeerista.com may verify the ability of the ordering party to pay and is entitled to refuse orders under certain conditions.

7. Prior to execution, the consumer is provided with the information referred to in Article 4, paragraphs 2–4.

8. Upon execution of the agreement, the consumer is provided with information on withdrawal rights, company address for complaints, and service/warranty information.


Article 7 – Price
1. Prices remain fixed during the offer period, except for statutory VAT changes. If applicable, variable prices will be indicated as approximate prices.

2. Price increases after conclusion are only allowed by law or if the consumer can terminate the contract before the price increase.


Article 8 – Conformity
Coffeerista.com guarantees that goods/services conform to the offer specifications and comply with existing legal requirements.

Article 9 – Warranty
1. Any warranty offered by Coffeerista.com does not affect the consumer's legal rights.

2. Manufacturer or importer warranties do not affect statutory consumer rights.


Article 10 – Order
1. Deliveries are made only on express order.

2. Unsolicited goods may be returned at no cost, except in case of obvious mistake.

3. Any obvious errors must be reported to Coffeerista.com.


Article 11 – Execution of the order
1. Coffeerista.com exercises maximum care when processing orders.

2. Delivery address is the consumer’s last known address unless otherwise agreed.

3. Orders are executed promptly, at least within 30 days; delays are communicated, and orders can be canceled at no cost.

4. If delivery is impossible, Coffeerista.com will provide replacement items. Return costs are borne by Coffeerista.com.

5. Risk of damage or loss remains with Coffeerista.com until delivery.


Article 12 – Ongoing transactions
1. Contracts of indefinite duration may be terminated at any time with a maximum notice period of three months.

2. Fixed-term contracts last a maximum of one year. Silent consent extensions have a maximum three-month notice period.

Article 13 – Payment
1. Payments are due before delivery.

2. Advance payment may not exceed 50%.

3. Errors in provided information must be reported immediately.

4. Coffeerista.com may charge reasonable costs in case of consumer default.


Article 14 – Disputes
1. Dutch law applies exclusively.

2. Disputes may be submitted to the Dispute Committee Thuiswinkel.

3. Complaints must first be submitted to Coffeerista.com.

4. Disputes must be submitted to the committee within three months.

5. Consumer choice: committee or competent court.

6. Committee decisions are binding as per the regulations.


Article 15 – Industry guarantee for compliance with binding decisions
1. The Dutch Post Order Association assumes obligations from binding committee decisions if Coffeerista.com fails to comply.

2. Claiming this guarantee requires a written appeal to the Dutch Post Order Association, P.O. Box 75959, 1070 AZ Amsterdam.

Article 16 – Changes to the terms
1. Changes will only occur after consultation with the Consumers’ Association.

2. Changes take effect after publication; the most favorable provision for the consumer prevails.
